Privacy Notice

The Myer Law Firm respects your right to privacy.  When we collect personal data about consumers, whether they be clients or client prospects, we keep it private.  We have physical, electronic, and procedural security measures in place that comply with legal standards to protect personal data.  The only employees who have access to consumer data are those who must have it to serve you.  This notice explains how we use consumer/client/prospect data.

OUR OBLIGATIONS AS ATTORNEYS TO MAINTAIN YOUR PERSONAL DATA

As attorneys, attorneys have a special obligation to keep client data confidential.  California Business and Professions Code §6068, regarding the "Duties of Attorney[s]," states that:

"It is the duty of an attorney to do all of the following:  . . .
e.  1.  To maintain inviolate the confidence, and at every peril to himself or herself to preserve the secrets, of his or her client.
2.  Notwithstanding paragraph (1), an attorney may, but is not required to, reveal confidential information relating to the representation of a client to the extent that the attorney reasonably believes the disclosure is necessary to prevent a criminal act that the attorney reasonably believes is likely to result in death of, or substantial bodily harm to, an individual."

DATA WE COLLECT

Personal data includes any identifying information about a consumer, such as:

• Name, residence address, e-mail address, phone number

• Age, marital status, occupation, social security number

• Work history, employer's name, employment address, income history

• Medical history, doctors' names, doctors' addresses, injuries

We collect personal data from a variety of sources, such as:

• From you in person, by telephone, or over the Internet

• From others when we investigate or verify your legal matter or make claims on your behalf

• Forms you submit to us, such as applications, questionnaires, or claims

• From your transactions with us, such as attorney fee and cost payments and retainer agreements

• From credit bureaus, to determine your credit standing to offer payment plan options

• From the DMV to verify driving record, auto title, or license status for you or others in your household

• From doctors that treat or evaluate you or have treated or evaluated you

• From government agencies regarding claims benefits, such as for unemployment insurance or workers compensation benefits

• From government agencies regarding administrative filings you have made, such as the Equal Employment Opportunity Commission or the California Department of Fair Employment and Housing

• From your employer or former employer to verify your employment status or history

    HOW WE USE AND DISCLOSE PERSONAL DATA

We do not sell personal data or customer lists to anyone.  We only disclose data about you as authorized, allowed or required by law.  In those instances, we may disclose personal data without your prior consent.  Our disclosures may include any personal data that is necessary in our representation of you, to help others provide legal services on our behalf, or to satisfy a lawful request.

We may disclose personal data we collect to:

• Opposing parties or their counsel or their insurance companies in making claims on your behalf

• Service providers, such as messengers or process servers, that assist us in providing legal services on your behalf

• Service providers that help send out our mailings, correspondence and newsletters

• Courts and governmental agencies in our representation of you or when their is a lawful request

• Assist law enforcement and prevent death or substantial bodily harm to individuals

When we use service providers to help us with services shown above, your personal data stays confidential.  Our service providers agree to keep consumer data private and not use it for any other purpose.  We do not share or sell consumer data to third parties for marketing.  We do not share credit information for marketing, or for any other reason, other than to collect a debt.  We only use medical data to process, evaluate, prosecute or defend claims.  We do not share medical data without your prior consent, except that we share medical data to make claims on your behalf for injuries that you may have suffered.

We do not have any affiliated companies.  Therefore, we do not share personal data with affiliates.  We treat former customer data the same way as current customer data.

YOUR RIGHT TO REVIEW AND CORRECT PERSONAL DATA

If you wish to review your personal data, please send a written request to:  Myer Law Firm, P.O. Box 18019, Beverly Hills, CA 90209-4019.  Include your name, address, telephone number and client/matter number (if any).  Let us know what kind of data you want to see.  If you see any mistakes, let us know and we will review it.  If we agree, we will correct our files.  If we disagree, you may file a short statement of dispute with us.  Your statement will be included with any data we disclose in the future.  We will also send the statement to anyone you ask who received your data from us in the past 2 years.
